These Terms & Conditions govern your use of summitpeakfitness.com (the “Website”) and your relationship with Summit Peak Fitness (“we”, “us”, or “our”). Please read these Terms carefully, as they affect your legal rights and obligations.

By accessing the Website, enrolling in a program, participating in a challenge, or purchasing any service, you agree to be bound by these Terms & Conditions. If you do not agree to these Terms, you must not use the Website or our services.

Eligibility

You must be at least eighteen (18) years of age to access or use this Website or any services provided by Summit Peak Fitness. By using the Website or services, you represent and warrant that you meet this eligibility requirement.

Services

Summit Peak Fitness provides online fitness and coaching services, including monthly online coaching, one-to-one coaching, group coaching, fitness challenges (free and paid), fixed-length training programs, nutrition guidance, and digital content such as courses, videos, and downloadable materials. All services are delivered remotely and are intended for educational and informational purposes only.

We reserve the right to modify, update, replace, suspend, or discontinue any service, program, feature, or content at any time without notice.

Medical and Nutrition Disclaimer

Summit Peak Fitness is not a medical provider or registered dietitian. Any exercise, fitness, or nutrition guidance provided through the Website or services is for educational purposes only and does not constitute medical advice.

You are strongly advised to consult with a qualified healthcare professional before beginning any exercise or nutrition program, particularly if you have a medical condition, injury, or health concern. Participation in physical activity carries inherent risks, and by using our services you acknowledge and voluntarily assume all such risks.

Nutritional and Exercise Recommendations

Any nutritional guidance and exercise recommendations provided by Summit Peak Fitness are based solely on the information you provide to us. It is your responsibility to ensure that all health, medical, dietary, and fitness-related information you submit is accurate, complete, and current. Inaccurate or incomplete information may result in recommendations that are not appropriate for you.

You acknowledge that you are responsible for consulting a qualified healthcare professional before making significant changes to your diet or exercise routine, especially if you have pre-existing medical conditions or concerns.

Personal Responsibility

You acknowledge that you are solely responsible for your own health, safety, and well-being. All programs, plans, recommendations, and guidance are based on the information you provide, and you are responsible for ensuring that such information is accurate, complete, and up to date.

Personalized training plans and nutrition guidance are provided only within one-to-one coaching services and are based solely on the information you submit. You agree to immediately stop any exercise or dietary change that causes pain, dizziness, discomfort, or adverse symptoms.

Results, Progress Guarantee & Adherence Requirements

Summit Peak Fitness provides structured coaching, guidance, accountability, and support to assist clients in achieving their fitness goals.

For qualifying coaching programs, Summit Peak Fitness offers a 12-week Progress Guarantee, subject to strict adherence requirements.

Progress Guarantee

The Coach guarantees that the Client will make visible progress within twelve (12) weeks, provided the Client follows the program exactly as prescribed. “Visible progress” is determined solely by Summit Peak Fitness using documented evidence including weekly check-ins, progress photos, measurements, performance metrics, habit tracking, and adherence data.

Client Adherence Requirements

To remain eligible for the Progress Guarantee, the Client must:

Complete 100% of assigned training, nutrition, and lifestyle actions.

Submit weekly check-ins accurately, honestly, and on time.

Follow all coaching instructions as provided.

Maintain participation for the entire 12-week program duration.

Any missed actions, incomplete adherence, inaccurate reporting, or deviation from the program will void the Progress Guarantee.

Missed Check-Ins & Termination

If a Client misses two (2) consecutive weekly check-ins in two (2) consecutive months, Summit Peak Fitness reserves the right to terminate the coaching relationship.

Termination for missed check-ins, non-participation, or non-adherence will be without refund.

Refund Eligibility

A refund will only be considered if all of the following conditions are met:

The Client completes the full 12-week program.

The Client demonstrates 100% adherence throughout the program, as verified by weekly check-in records.

A written refund request is submitted within seven (7) days of completing week twelve.

Summit Peak Fitness determines, based on documented evidence, that the Client did not achieve visible progress despite full compliance.

Refund Exclusions

No refunds will be issued if:

The Client fails to follow the program exactly as prescribed.

The Client self-reports less than full adherence at any point.

Weekly check-ins are missed or incomplete.

The Client is terminated for non-compliance or non-participation.

Dissatisfaction is based on personal expectations rather than documented adherence.

Coach Determination

All determinations regarding adherence, progress, eligibility, and refunds are made solely at the discretion of Summit Peak Fitness and are final.

Payments, Programs, and Subscriptions

Summit Peak Fitness may offer free challenges, fixed-length paid programs, monthly recurring memberships, and month-to-month one-to-one coaching. All payments are billed in advance through third-party payment processors.

By purchasing a subscription or program, you authorize recurring charges according to the selected billing cycle. Subscriptions may be cancelled at any time to prevent future charges. Upon cancellation, access will continue until the end of the current billing period. Subscriptions cannot be paused or temporarily suspended.

Refund Policy (General)

Except where explicitly stated under the 12-Week Progress Guarantee, all sales are final. No refunds, partial refunds, credits, or chargebacks are provided for digital products, subscriptions, challenges, or services.

Communication, Community, and Support

Communication and support are provided through designated platforms. We do not provide emergency or medical support.

Participation in group coaching or community spaces requires respectful conduct. We reserve the right to remove or restrict access to any participant who engages in disruptive, unsafe, or inappropriate behavior.

Intellectual Property

All content provided by Summit Peak Fitness is the intellectual property of Summit Peak Fitness and may not be copied, shared, resold, or distributed without written consent.

By submitting testimonials or content, you grant Summit Peak Fitness the right to use such materials for marketing purposes without compensation.

Prohibited Use

You may not use the Website or services unlawfully, fraudulently, abusively, or in violation of these Terms.

Website Availability

All services and content are provided on an “as is” and “as available” basis.

Limitation of Liability

To the maximum extent permitted by law, Summit Peak Fitness shall not be liable for injuries, losses, or damages arising from participation in any program or use of the Website.

Termination of Services
